Palmer Prevails in litigation. 3rd DCA denies Palmetto Bay's petition for writ of certiorari

The Third DCA released its opinion today, Thursday, July 5, 2012.  The 3 member appellate panel DENIED Palmetto Bay's petition for writ of certiorari.

  1. Why Gene. Why do we have to read this here? Why are you the only one who puts out all information? I just looked again on both the village Facebook and website and there is absolutely no mention of this Palmer decision. It is all carefully controlled happy news. It is as if the Mayor and Council want to pretend that nothing is happening, that we won’t find out that they wasted even more tax dollars on a fight they are never going to win. Village headlines on the website include summer camp, summer senior sampler, fireworks, but nothing about important information.

    Does this mean Palmetto Bay will now finally update their own litigation page?

    Note the disclaimer. Will that be changed to reflect the latest loss?

    In my 30 years of law practice, I have yet to see such illogical waste of taxpayer dollars. I would be surprised if the school does not now move to recover its legal fees and costs from the Palmetto Bay taxpayers. And it may just once again prevail. It is time to capitulate, cut losses, and show true leadership instead of shallow showsmanship.
